SC CONTEMPORARY
RETURN, REFUND, SHIPPING DAMAGE, RESTORATION AND RE-CREATION POLICY

This policy applies to original artworks purchased from SC Contemporary.
GENERAL RETURN POLICY
Original artworks are generally final sale and are not voluntarily accepted for return solely because of a change of mind.
This rule does not apply where mandatory consumer law grants the customer a statutory right to cancel, withdraw, return the artwork, or receive a remedy.
Shipping damage, confirmed loss, incorrect delivery, material defects, and artworks that materially differ from their description are handled separately and are not treated as change-of-mind returns.
Nothing in this policy limits any consumer right or remedy that cannot lawfully be excluded.
CANCELLATION BEFORE DISPATCH
Customers should contact SC Contemporary immediately if they wish to cancel an order before dispatch.
A voluntary cancellation may be accepted before substantial order-specific preparation has commenced.
Cancellation may no longer be available after SC Contemporary or the artist has begun one or more of the following:
• final condition inspection;
• transfer of the artwork to SC Contemporary;
• specialist packaging or repackaging;
• preparation of a shipping label;
• preparation of customs or export documentation;
• carrier booking; or
• another order-specific preparation process.
Where applicable law grants the customer a mandatory cancellation or withdrawal right, that right will be honoured regardless of this voluntary cancellation policy.
STATUTORY CANCELLATION AND WITHDRAWAL RIGHTS
Where mandatory consumer law grants an eligible customer a statutory right to cancel or withdraw from an online purchase, SC Contemporary will honour that right in accordance with the applicable law.
The customer must notify SC Contemporary within the legally applicable cancellation or withdrawal period.
Depending on the law applicable to the transaction, the statutory notice period may be seven or fourteen days after delivery.
Where a fourteen-day distance-selling withdrawal period applies, the customer must notify SC Contemporary within fourteen days after receiving the artwork and return it within the further period required by applicable law.
For an eligible statutory change-of-mind return:
• SC Contemporary will refund the amounts required by applicable law;
• the original standard outbound delivery cost will be refunded only where required by applicable law;
• the customer is responsible for the direct cost of returning the artwork, including suitable protective packaging, tracking, and adequate insurance, where permitted by law and disclosed before purchase;
• additional amounts paid for a delivery method more expensive than SC Contemporary’s standard delivery method may be excluded from the refund where permitted by law; and
• SC Contemporary may withhold the refund until the artwork has been received or the customer provides satisfactory evidence that it has been returned.
Because original artworks may require specialist international transportation, the cost of return shipping, protective packaging, and insurance may be substantial and may equal or exceed the original outbound shipping cost.
No return should be sent before the customer receives written return instructions from SC Contemporary.
CHANGE-OF-MIND RETURNS OUTSIDE A STATUTORY RIGHT
SC Contemporary does not voluntarily accept change-of-mind returns where no mandatory cancellation or withdrawal right applies.
Where SC Contemporary exceptionally agrees in writing to accept a voluntary return:
• the customer is responsible for all return shipping, professional packaging, tracking, insurance, customs, and clearance costs;
• the actual outbound shipping and insurance costs already incurred by SC Contemporary are non-refundable to the extent permitted by applicable law;
• the artwork must be returned in its original delivered condition;
• the Certificate of Authenticity and all accompanying documents must be returned; and
• the return must follow the written instructions issued by SC Contemporary.
Exceptional acceptance of one return does not create a continuing right to return other purchases.
CONDITION OF RETURNED ARTWORK
Any artwork approved for return must be:
• returned in the same condition in which it was delivered;
• free from new damage, alteration, installation marks, stains, odours, smoke exposure, moisture, mould, or environmental deterioration;
• accompanied by the original Certificate of Authenticity, labels, and documents;
• packed securely using the original packaging materials wherever reasonably possible;
• returned using a tracked shipping service; and
• insured for an amount approved by SC Contemporary.
The customer may be responsible for a reduction in value caused by handling beyond what is reasonably necessary to inspect the artwork, to the extent permitted by applicable law.
The customer remains responsible for the artwork until it has been safely received by SC Contemporary.
SHIPPING DAMAGE, LOSS, OR INCORRECT DELIVERY
Shipping damage, confirmed loss, misdelivery, incorrect delivery, and material differences from the product description are handled separately from change-of-mind returns.
The customer must contact SC Contemporary directly.
All communication concerning liability, compensation, restoration, re-creation, return, or refund must be managed through SC Contemporary.
The customer must not make a separate agreement with the artist concerning financial compensation, liability, restoration, re-creation, or refund unless SC Contemporary confirms that agreement in writing.
SC Contemporary will review:
• the documented condition of the artwork before shipment;
• the packaging and dispatch records;
• the customer’s photographs and video;
• the carrier’s tracking and delivery records;
• the external and internal packaging condition;
• the location, type, and severity of the damage;
• whether restoration is reasonably possible; and
• any relevant carrier or insurance assessment.
Carrier and insurance claims are handled separately by SC Contemporary.
The outcome of a carrier or insurance claim does not remove any customer right or remedy that cannot lawfully be excluded.
Any compensation later recovered from a carrier or insurer is used by SC Contemporary to offset the cost of resolving the claim and related losses. It is not automatically payable directly to the customer.
24-HOUR SHIPPING DAMAGE REPORTING PERIOD
Visible shipping damage should be reported to SC Contemporary within twenty-four hours after delivery.
The customer should inspect and photograph the unopened outer package immediately upon receipt.
Prompt reporting is required because carrier and insurance claims depend on evidence showing the condition of the shipment at the time of delivery.
A claim submitted after twenty-four hours may be restricted or rejected where the delay prevents SC Contemporary, the carrier, or the insurer from determining when or how the damage occurred.
A claim is not automatically classified as buyer-caused damage solely because it was reported after twenty-four hours.
The twenty-four-hour reporting request does not limit any consumer right or remedy that cannot lawfully be excluded.
REQUIRED SHIPPING-DAMAGE DOCUMENTATION
To initiate a shipping-damage claim, the customer must provide:
• the order number;
• the delivery date and approximate delivery time;
• clear photographs of every side of the unopened outer package;
• close-up photographs of dents, punctures, crushing, moisture, tears, or other visible packaging damage;
• a clear photograph of the shipping label;
• photographs showing the internal packaging materials and their arrangement;
• full front and back photographs of the artwork;
• close-up photographs of every damaged area;
• a written description of when and how the damage was discovered; and
• an unedited unboxing video, if available.
The artwork, outer box or tube, frame, internal packaging, protective materials, and shipping labels must be retained until SC Contemporary confirms in writing that they may be discarded.
SC Contemporary may request:
• additional photographs or video;
• measurements;
• a carrier inspection;
• a written assessment from the artist;
• a restoration assessment;
• a local repair quotation; or
• return of the artwork.
Failure to retain the artwork or packaging may prevent SC Contemporary from completing a carrier or insurance claim.
DETERMINATION OF RESPONSIBILITY
Responsibility will be determined from the available evidence and the circumstances of the damage.
SC Contemporary or Artist Responsibility may include:
• a defect that existed before shipment;
• incomplete drying, finishing, or surface protection;
• inadequate or improper packaging; or
• another condition present before the artwork entered international transit.
Carrier Responsibility may include:
• damage occurring during transit where appropriate packaging standards were met;
• loss;
• misdelivery;
• external impact, crushing, puncture, or moisture damage supported by evidence; or
• damage occurring during transportation or official handling.
Buyer Responsibility may include:
• damage caused while opening the package, including damage caused by knives or cutters;
• damage caused during installation, mounting, relocation, or handling;
• damage caused by unsuitable hardware or inadequate wall support;
• damage caused by direct sunlight, humidity, moisture, heat, cold, or rapid temperature changes;
• damage caused by smoke, chemicals, cleaning products, mould, pests, or pets;
• damage occurring during transportation independently arranged after delivery; or
• damage whose cause and timing cannot reasonably be verified because the artwork, packaging, or required evidence was not retained.
AVAILABLE RESOLUTIONS
The appropriate resolution depends on:
• the type and severity of the damage;
• whether the artwork itself or only an external component is affected;
• whether restoration is possible;
• whether restoration would preserve the integrity and value of the artwork;
• the artist’s professional assessment;
• return and transportation feasibility;
• the customer’s legally relevant preference; and
• applicable consumer law.
Possible resolutions may include:
• replacement of a damaged frame or other replaceable component;
• local repair or restoration;
• return of the artwork for restoration;
• re-shipment after restoration;
• a partial refund where the customer agrees to retain the artwork;
• return and full refund in cases of severe or irreparable damage;
• full refund in the event of confirmed loss; or
• artist-approved re-creation where appropriate and feasible.
Re-creation is not the standard resolution for damage to an original artwork.
SC Contemporary does not guarantee that every original artwork can be repaired, restored, or recreated.
RESTORATION OR REPAIR
For minor or moderate damage, restoration may be possible.
Where damage occurred during shipping and falls within the responsibility of SC Contemporary, the artist, or the carrier, SC Contemporary will determine the appropriate restoration and customer-resolution process after reviewing the claim.
Where damage was caused by the buyer after delivery, paid restoration may be offered at the discretion of SC Contemporary and the original artist.
Restoration fees may include:
• assessment of the extent and visibility of the damage;
• the artist’s or restorer’s time and labour;
• required materials;
• colour, surface, and finish matching;
• repackaging;
• domestic transportation;
• return shipping; and
• international re-shipping and insurance.
Restoration will be performed by the original artist unless SC Contemporary approves another qualified professional.
A written quotation will be provided for approval before any paid restoration work begins.
PAID RE-CREATION FOR BUYER-CAUSED DAMAGE
Where an artwork is damaged through unpacking, installation, handling, storage, environmental exposure, or another cause attributable to the buyer, the artist may offer a paid re-creation option as a courtesy.
The standard re-creation fee begins at seventy percent of the original artwork price, excluding the original shipping cost.
Depending on the labour, materials, technical difficulty, and conceptual or emotional burden involved, the fee may be adjusted up to one hundred percent of the original artwork price following agreement between SC Contemporary and the artist.
The following costs are charged separately:
• domestic transportation;
• repacking;
• international shipping;
• insurance; and
• applicable customs or clearance charges.
Paid re-creation is limited to one occurrence per order.
The recreated artwork will correspond to the original in size, medium, and conceptual intent. Exact brushwork, gesture, colour relationships, texture, surface detail, and other handmade characteristics may vary.
Re-creation is not guaranteed.
The artist may decline re-creation where:
• faithful re-creation is conceptually or technically impossible;
• re-creation would compromise the uniqueness or integrity of the original;
• the emotional, physical, or technical burden is excessive;
• required materials or processes are no longer available; or
• the artist’s existing schedule makes re-creation impracticable.
RESTORATION AND RE-CREATION CONDITIONS
Paid restoration and re-creation services are offered at the discretion of SC Contemporary and the artist.
Production and restoration schedules depend on the artist’s existing commitments.
Expedited or priority restoration or production is not available.
All quoted fees must be paid and confirmed before work begins.
SC Contemporary will provide an estimated schedule after consultation with the artist.
CUSTOMS INSPECTION AND REPACKAGING
International shipments may be opened, inspected, held, or repackaged by customs, security, or government authorities.
Official opening, inspection, or minor alteration of the packaging does not by itself constitute damage to the artwork.
Where official handling causes actual physical damage to the artwork, the customer must follow the shipping-damage reporting and documentation procedure in this policy.
REFUNDS
Where a refund is approved or legally required, it will be issued to the original payment method unless another method is required or agreed.
SC Contemporary may withhold a return-related refund until:
• the returned artwork has been received; or
• the customer provides satisfactory evidence that the artwork has been returned,
where permitted by applicable law.
For a voluntarily accepted return that is not based on a statutory cancellation right, actual outbound shipping and insurance costs already incurred by SC Contemporary may be excluded from the refund to the extent permitted by law.
Import duties, VAT, GST, brokerage fees, customs-clearance charges, and other amounts paid directly to customs authorities or carriers are not collected by SC Contemporary and cannot normally be refunded by SC Contemporary.
The customer may need to apply separately to the relevant customs authority for any available import-tax refund.
FINAL RESOLUTION
SC Contemporary will propose a resolution after reviewing the evidence, the condition of the artwork, restoration feasibility, and applicable legal requirements.
Once the customer accepts a resolution and SC Contemporary completes that resolution, the claim will be treated as closed.
Nothing in this section limits any right or remedy that cannot lawfully be excluded.
