SC CONTEMPORARY
TERMS OF SALE

These Terms of Sale apply to purchases of original artworks from SC Contemporary.
By placing an order, the buyer confirms that the buyer has reviewed and accepted:
• these Terms of Sale;
• the International Shipping, Delivery and Customs Policy; and
• the Return, Refund, Shipping Damage, Restoration and Re-creation Policy.
SELLER AND CUSTOMER COMMUNICATION
SC Contemporary manages:
• the sale;
• payment communication;
• order preparation;
• international shipping;
• customs communication;
• damage and loss claims;
• restoration arrangements;
• re-creation arrangements;
• returns; and
• refunds.
The buyer must direct all order, return, claim, and payment communication to SC Contemporary.
The buyer must not make a separate agreement directly with the artist concerning:
• liability;
• financial compensation;
• refund;
• restoration;
• re-creation;
• return;
• international shipping; or
• payment.
Any such agreement is not binding on SC Contemporary unless SC Contemporary confirms it in writing.
ORIGINAL ARTWORKS
Each original artwork is a unique work.
Depending on the artist’s materials and process, an artwork may include:
• visible brushwork;
• impasto;
• handmade edges;
• surface texture;
• variations in gloss or finish;
• natural material variations;
• minor irregularities inherent to handmade production; or
• other characteristics resulting from the artist’s process.
These characteristics do not constitute a defect where they form part of the artwork as described or displayed.
Photography, lighting, image processing, and screen settings may cause minor differences in colour appearance.
The buyer is responsible for reviewing the artwork’s description, artist, medium, dimensions, framing status, shipping format, and care information before placing an order.
ORDER CONFIRMATION AND PAYMENT
An order is not fully confirmed until payment has been successfully received or cleared.
SC Contemporary may contact the artist to reconfirm availability before dispatch.
No restoration, re-creation, or other paid artwork service will begin until the quoted payment has been confirmed.
ORDER PREPARATION
Original artworks may be stored at the artist’s studio rather than centrally at SC Contemporary.
Before dispatch, an order may require:
• artist coordination;
• transfer of the artwork;
• availability confirmation;
• condition inspection;
• pre-shipment photography;
• preparation of authenticity documents;
• customs documentation;
• specialist packaging; and
• carrier booking.
Unless otherwise stated, the buyer must allow up to seven business days after confirmed payment for preparation before international dispatch.
SHIPPING METHOD AND FORMAT
The shipping method is determined according to:
• artwork dimensions;
• medium;
• packed dimensions;
• weight;
• destination;
• declared value;
• postal restrictions;
• carrier requirements; and
• insurance requirements.
SC Contemporary may use K-Packet, Korea Post EMS, DHL Express, or another appropriate tracked international service.
Certain large canvases may be removed from their stretcher and shipped rolled in a protective tube.
Where rolled shipping applies, it will be stated on the product page or communicated before dispatch.
SHIPPING COST
For designated destinations, the expected standard international shipping cost may be incorporated into the listed artwork price.
Included shipping does not include import duties, VAT, GST, local taxes, brokerage fees, customs-clearance charges, storage fees, or other destination-country charges.
Exceptional destinations, oversized shipments, optional insurance, and special services may require an additional charge agreed before dispatch.
CUSTOMS AND IMPORT RESPONSIBILITY
Unless expressly agreed otherwise, the buyer is the importer of record.
The buyer is responsible for:
• customs duties;
• import VAT or GST;
• local sales or use taxes;
• customs-clearance and brokerage charges;
• carrier advancement or disbursement fees;
• inspection, permit, and storage charges;
• documents requested by customs; and
• responding promptly to customs and carrier communications.
SC Contemporary cannot determine or guarantee the final destination-country charges.
The buyer acknowledges that zero customs duty does not necessarily mean that no import VAT, GST, local tax, or clearance fee will apply.
DELIVERY ESTIMATES
Preparation and transit estimates are provided for guidance only.
International delivery may be affected by customs, public holidays, carrier operations, airline schedules, security reviews, weather, natural disasters, labour disruption, public-health events, failed delivery attempts, or another factor outside the reasonable control of SC Contemporary.
A normal external delay does not automatically constitute grounds for cancellation, refund, or compensation.
Nothing in this section limits a mandatory legal right.
CUSTOMS INSPECTION
The buyer acknowledges that customs or security authorities may open, inspect, hold, or repack the shipment.
SC Contemporary does not control official inspection or repackaging procedures.
Minor packaging changes resulting from official inspection do not by themselves constitute artwork damage.
Actual physical damage to the artwork must be reported under the Return and Refund Policy.
CANCELLATION AND CHANGE-OF-MIND RETURNS
Original artworks are generally final sale where no mandatory statutory cancellation or withdrawal right applies.
Where mandatory consumer law grants an eligible customer a statutory right to cancel or withdraw from an online purchase, SC Contemporary will honour that right in accordance with the applicable law.
Depending on the applicable jurisdiction, the statutory period may be seven or fourteen days after delivery.
For an eligible statutory change-of-mind return:
• SC Contemporary will refund the amounts required by applicable law;
• the original standard outbound delivery cost will be refunded only where required by applicable law;
• the buyer is responsible for direct return shipping, protective packaging, tracking, and adequate insurance where permitted by law and disclosed before purchase; and
• SC Contemporary may withhold the refund until the artwork is received or satisfactory evidence of return is provided.
Where SC Contemporary voluntarily accepts a change-of-mind return outside a mandatory statutory right, actual outbound shipping and insurance costs already incurred may be excluded from the refund to the extent permitted by applicable law.
SHIPPING DAMAGE AND LOSS
Shipping damage and confirmed loss are exceptions to the general final-sale policy.
Visible shipping damage should be reported within twenty-four hours after delivery together with the evidence required under the Return and Refund Policy.
SC Contemporary will assess:
• the artwork’s pre-shipment condition;
• the packaging records;
• the buyer’s evidence;
• the carrier’s records;
• the cause and severity of damage;
• restoration feasibility; and
• applicable consumer law.
Depending on the circumstances, the resolution may include:
• replacement of an external component;
• restoration;
• partial refund;
• return;
• full refund; or
• artist-approved re-creation.
Carrier and insurance claims are handled separately by SC Contemporary.
BUYER-CAUSED DAMAGE
After successful delivery, the buyer is responsible for damage caused by:
• unsafe unpacking;
• knives or cutters;
• improper handling;
• installation;
• unsuitable wall hardware;
• impact or dropping;
• inappropriate storage;
• direct sunlight;
• excessive humidity or moisture;
• excessive heat or cold;
• rapid temperature changes;
• smoke;
• chemicals or cleaning products;
• mould, pests, or pets; or
• transportation independently arranged after delivery.
Damage resulting from these causes is not treated as shipping damage.
Paid restoration or re-creation may be offered at the discretion of SC Contemporary and the artist.
INSTALLATION AND CARE
Professional installation is strongly recommended for large, heavy, framed, or delicate artworks.
The buyer should:
• handle the artwork with clean, dry hands;
• lift it from the frame or stretcher bars;
• avoid pressure on the painted surface;
• use appropriate wall hardware;
• avoid direct sunlight;
• avoid excessive humidity and rapid temperature changes;
• maintain a stable indoor environment; and
• retain the original packaging for future transport.
A relative-humidity range of approximately forty to sixty percent and a stable room temperature are recommended.
SC Contemporary is not responsible for deterioration or damage caused after delivery by improper installation, handling, storage, or environmental exposure.
RESTORATION AND RE-CREATION
Restoration and re-creation are not guaranteed.
For buyer-caused damage, paid restoration or re-creation may be offered only after consultation with the original artist.
A written quotation will be provided before paid work begins.
The standard re-creation fee begins at seventy percent of the original artwork price and may be adjusted up to one hundred percent according to labour, materials, technical difficulty, and conceptual or emotional burden.
Domestic transportation, repacking, insurance, and international re-shipping are charged separately.
Re-creation is limited to one occurrence per order and remains subject to the artist’s approval and schedule.
Expedited or priority restoration or re-creation is not available.
INCORPORATED POLICIES AND FINAL RESOLUTION
The International Shipping, Delivery and Customs Policy and the Return, Refund, Shipping Damage, Restoration and Re-creation Policy form part of these Terms of Sale.
Once the buyer accepts a resolution and SC Contemporary completes that resolution, the related claim will be treated as closed.
Nothing in these Terms limits any right or remedy that cannot lawfully be excluded.
GOVERNING LAW
These Terms are governed by the laws of the Republic of Korea.
This governing-law provision does not remove any mandatory consumer protection that applies to the buyer and cannot lawfully be excluded.
POLICY UPDATES
SC Contemporary may update these Terms and related policies for future transactions.
The version in effect when the order is placed applies to that order, except where applicable law requires otherwise.
